The complication sits at the state level, where Nevada has an active court-ordered restriction and several other states have issued cease-and-desist actions still working through the courts.
Which model you can access depends partly on your state. CFTC-regulated exchanges like Kalshi and Polymarket operate under federal oversight, but a handful of states have pushed back on their sports contracts specifically.
Crypto-native and sweepstakes-based platforms typically face fewer state-level restrictions, making them a practical route if your state has active enforcement against the regulated exchanges.
