A Spanish court yesterday ruled that Sportingbet must shut down its online gaming sites Miapuesta.com and Miapuesta.es, the former of which offers online poker to Spanish residents.

The 10th Mercantile Court ruled on behalf of Spanish gaming operator Codere which was seeking to shut out unlicensed operators claiming unfair competition.

The court said that “any offering of gaming or betting activity that has not been granted a prior administrative authorisation is indisputably prohibited”.

Spain is in the process of regulating its online gambling market.

Codere said after the ruling, ““This situation has been explicitly acknowledged by the Spanish government before parliament and the European Union Commission.

“The legal implications of the ruling are very significant as it considers the operation of the said websites illegal and also declares the applicability of a specific sanctions regime of both the state and the Spanish regions to this type of conduct.

Miapuesta.com was still live at the time of writing while Miapuesta.es displayed a ‘Coming Soon’ notice.
